A US judge has dismissed criminal charges against former FBI Director James Comey and New York Attorney General Letitia James, ruling that the prosecutor who brought the charges was unlawfully appointed.
Judge Cameron Currie stated that Lindsey Halligan, who was appointed by former President Trump to bring the charges against the two political adversaries, was ineligible for the role.
Both Comey and James have maintained their innocence, characterizing the prosecutions as politically motivated. In response to the ruling, the White House stated: The facts of the indictments against Comey and James have not changed, and this will not be the final word on this matter.
President Trump has consistently attacked Comey and James, claiming in a social media post that They're all guilty as hell, further declaring, JUSTICE MUST BE SERVED, NOW!!!.
Judge Currie articulated that Halligan's appointment was flawed, pointing out that her previous lack of prosecutorial experience and the procedural missteps surrounding her appointment rendered all actions taken by her to be unlawful.
The judge ruled, All actions flowing from Ms Halligan's defective appointment, including securing and signing Mr Comey's indictment, were unlawful exercises of executive power and are hereby set aside.
Following the ruling, Comey expressed relief that a prosecution he deemed based on malevolence and incompetence had concluded, yet he warned that Trump may continue to pursue him legally.
James also reacted positively, stating she felt heartened by today's victory and affirmed her continued commitment to fighting baseless charges.
While the charges have been dismissed without prejudice, allowing for potential refiling, White House Press Secretary Karoline Leavitt announced that the Justice Department would appeal the decision, asserting Halligan's legal appointment.
