Judge Declares Defense Department’s Anthropic Designation Illegal

A U.S. district judge has ruled that the Department of Defense illegally designated AI startup Anthropic as a supply‑chain risk, calling the move “illegal and baseless.”


The company had refused to let the military use its Claude models for surveillance or autonomous weapons, and the Pentagon demanded a new contract clause. Anthropic argued this was an overstep of authority and sought a removal of the designation.


Judge Rita Lin said that citing national security does not give the government a blank check to punish critics. She noted that this action seemed aimed at chilling public debate and was a classic First Amendment retaliation.


The Pentagon’s designation was announced in February and marked the first time an American company had been publicly labelled a supply‑chain risk, a category usually reserved for foreign firms posing a threat.


Anthropic welcomed the ruling, stating it remains committed to collaborating with the government to harness AI for national security while protecting its speech rights.


The court’s decision highlights the growing friction between AI firms and U.S. defense agencies over the use of advanced technologies in military contexts, and underscores the limits on using national security claims to suppress corporate dissent.
